Habeas corpus is a legal procedure that allows for a person to go to court to prove whether their detention is lawful (innocent until proven guilty). Habeas corpus has been around since its royal assent in 1701, it was originally implemented due to disputes over civil liberties. Stephen Miller and the Trump administration are actively looking at removing this right. They are looking at revoking it because of the “invasion” of illegal immigrants. Both Miller and the Trump administration believe that the continuation of allowing undocumented immigrants into the country will harm our natural resources and the economy. Stephen Miller is a far right political advisor serving as white House deputy chief since 2015. Miller is known for being the primary author of immigration policies and the reduction of refugee camps in America, he has shaped president trump’s racist viewpoints and actions. In the past habeas corpus has been temporarily suspended due to war and in emergency situations such as rebellion and invasion, since the trump administration believes that we are under a time of invasion, habeas corpus can be suspended. The suspension of habeas corpus would make it impossible for innocent people to get the justice in which they deserve. This suspension could be beneficial for some situations where an intense crime is committed because then it would be a definite sentencing for the individual. While this suspension could be helpful for sentencing real criminals, the problem of innocent people being convicted of crimes that they didn’t commit still stands.
